These Terms of Use (“Terms”) govern your use of the platform and services of 360HomeAudit Private Limited (“360HomeAudit”, “we”, “our”, or “us”) available through our website www.360homeaudit.com, and any subdomains, mobile applications, digital tools, or software managed or owned by us (collectively, the “Platform”).
By using the Platform and our Services, you agree to these Terms, our Privacy Policy, Refund & Cancellation Policy, and other policies published on the Platform.
1. Platform Overview & Services
360HomeAudit is a professional service provider offering:

Our inspections and consultations are non-invasive, advisory, and technical in nature. We do not offer legal, municipal, or government-certified reports unless explicitly mentioned.

2. Scope of Services (With Legal Disclaimer)
360HomeAudit performs only technical, visual, and advisory services related to construction and property condition. We do not offer any of the following services:
- ❌ Structural safety certification (unless signed by a licensed partner)
- ❌ Legal verification of property documents such as:
- Title deeds
- Mutation certificates
- Encumbrance certificates
- Sale/purchase agreements
- Builder registration or ownership documents
- ❌ RERA or municipal approval verification
- ❌ Legal advice or representation of any kind
📌Our Home Inspection Services are strictly limited to non-invasive, visual assessment of surface-level civil elements such as:
- Flooring, tiles, walls, ceiling cracks
- Plumbing and leakage issues
- Fittings and finishing
- Electrical socket alignment
- Doors/windows alignment and usability
🛑Legal Note:
As per the Transfer of Property Act, 1882, and RERA Act, 2016, the buyer is responsible for verifying all legal ownership and registration-related aspects with the help of a certified lawyer or registered real estate professional.

360HomeAudit’s reports are not to be used for legal proceedings or treated as certified evidence under the Indian Evidence Act, 1872 (Sections 17 & 45). We do not take any liability for legal or regulatory outcomes based on our reports.

3. Payment & Refund Policy
- 100% advance is required for booking.
- Refunds are governed by our Refund Policy, available on the Platform.
- No refund will be issued if cancellation is within 24 hours of a scheduled inspection.

4. User Obligations
- You shall not misrepresent property details.
- You shall ensure site access is provided on time.
- You agree not to misuse, reproduce, share, or alter inspection reports.
🛑Violation of this clause may attract legal action under:
- The Copyright Act, 1957
- The Information Technology Act, 2000 (Section 43 & 66 – Data misuse)
5. Account & Security
- You are responsible for maintaining confidentiality of your login credentials.
- Notify us immediately of any unauthorized use.

6. Eligibility
Only persons competent to contract under the Indian Contract Act, 1872 (Section 11) may use our platform. Minors are not permitted to register independently.
7. Limitation of Liability
360HomeAudit shall not be liable for:
- Defects not visible at the time of inspection
- Future structural damage or material failure
- Decisions taken solely based on the inspection report
- Any loss of business or profit from service outcomes

8. Intellectual Property
All content, reports, designs, templates, and documentation remain the intellectual property of 360HomeAudit. No part of the content may be copied, distributed, or reused without written consent.

9. Termination & Suspension
360HomeAudit reserves the right to terminate your access or services at any time without prior notice in case of:
- Breach of terms
- Non-payment
- Misuse of services or content

10. Dispute Resolution & Jurisdiction
All disputes shall be subject to the jurisdiction of the courts in Kolkata, West Bengal, and governed by the laws of India.
Disputes shall first be resolved through mediation or arbitration as per the Arbitration and Conciliation Act, 1996.
11. Service Modification and Availability
360HomeAudit may modify or discontinue services without prior notice. This includes but is not limited to inspection tools, website features, or mentorship offerings.
12. Re-Inspection Policy
- Re-inspection is available within 3 months at 80% of the base inspection fee.
- Re-inspection covers only previously identified defects.
- 360° imagery and new issue detection are excluded.
13. Use of Reports
Reports are:
- Valid for personal reference only
- Not to be circulated publicly without prior consent
- Not legal verdicts or construction quality certificates
Unauthorized usage may result in indemnification claims and civil/criminal liability.
14. Prohibited Use
- You may not use the Platform to commit fraud, violate laws, or harm others.
- Usage for defamation, harassment, or copyright breach is strictly prohibited.
15. Data Collection & Use
Your personal information is handled as per our Privacy Policy, compliant with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
16. Indemnity
You agree to indemnify and hold harmless 360HomeAudit and its affiliates from all losses, liabilities, damages, and costs arising from:
- Breach of these Terms
- Misuse of reports or services
- Violation of law or third-party rights
17. Maintenance & Updates
360HomeAudit may schedule downtime for system updates or upgrades. We are not liable for any resulting service delays or losses.
18. Errors & Omissions
360HomeAudit is not liable for:
- Typographical or system errors on the Platform
- Inaccuracies in third-party data or service partner content
We reserve the right to update or remove such information without notice.
19. RERA Disclaimer
360HomeAudit is not a RERA-registered real estate agent or developer. Buyers must verify all property information directly from state-wise RERA websites:
